    These terms and conditions of use ("Terms of Use") of the Website (www.giftract.com) between Gifting Technologies LLP (hereinafter referred to as "Giftract") and the users/ registrants of the Website ("You" or "Your" or "Yourself" or "User") describe the terms on which Giftract offers, you access to the Website and the Services (as defined below) through the Website.

    Please read the terms of use carefully before using or registering on the website or accessing any material, information or services through the website. Your use of the website or the services provided by the website shall signify your acceptance of the terms of use and your agreement to be legally bound by the same.

    You may need your own Giftract account to use certain Giftract Services, and you may be required to be logged into the account and have a valid payment method associated with it.

    If you use any Giftract Service you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and to the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided.     You must not use any Giftract Service: (i) in any way that causes, or is likely to cause, any Giftract Service, or any access to it to be interrupted, damaged or impaired in any way, or (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity, or (iii) to cause annoyance, inconvenience or anxiety.

    We reserve the right to refuse service, terminate accounts or remove or edit content if you are in breach of applicable laws, these Conditions of Use or any other applicable terms and conditions, guidelines or policies.

    PLATFORM SERVICES

    ·         Giftract does not offer returns or refunds on any products as they are custom created for you.

    ·         Orders once placed cannot be cancelled as we begin our customisation services as soon as your order is confirmed.

    ·         Changes to any of our products cannot be made once they have been delivered. Any changes in data must be informed at least 48 hours prior to the expected delivery of the product. Last minute changes will be considered as fresh customisation and add to the delivery time accordingly.

    ·         We offer guaranteed 48 hour delivery on all products listed on our website. You may opt for a faster delivery of 24 hours at extra charges. This delivery method will be subject to the same terms and conditions as our 48 hour guaranteed delivery mechanism. The delivery time is subject to the following conditions:

    -The 48 hours begin only after the customer has submitted complete data required in order for customisation of your product. The data requirement will be deemed to approval by Giftract based on the product and its level of customisation.

    - In case of delay from the customer in submitting the data on time, the product delivery maybe delayed beyond the stipulated date.

    - The 48 hour delivery time does not include scheduled or public holidays.

    - Delivery of products and technical support for the same will be provided only within the stipulated working hours i.e. 10:30am to 6:30pm Monday to Saturday. In special cases, Giftract may deliver products or provide assistance beyond these hours. However, the same will be based on our discretion. In no situation is Giftract liable to provide support or delivery beyond the stipulated hours.

    - If the concerned person is not available at the time of delivery or does not respond to our communication, Giftract cannot ensure delivery on the scheduled time and date.

    - While we always try 100% to ensure deliveries on time, there could be delays due to weather, calamities and other unavoidable reasons that are beyond our control. In such cases, your surprise will be delivered at the earliest.

    ·         All worldwide rights, titles, and interests are legally reserved. The contents of our website and the website as a whole are intended solely for your personal and non-commercial use. Any use of our website and its content for purposes other than personal and non-commercial use is prohibited without the prior written permission of Giftract. You cannot reproduce, publish, display, modify, sell, or distribute any of the materials from Giftract.

    LINKS TO THIRD PARTY WEBSITES

    The Website may contain links and interactive functionality interacting with the websites of third parties like Facebook and PayuMoney and others. Giftract is not responsible for and has no liability for the functionality, actions, inactions, privacy settings, privacy policies, terms, or content of any such website. Before enabling any sharing functions to communicate with any such website or otherwise visiting any such website, Giftract strongly recommends that you review and understand the terms and conditions, privacy policies, settings, and information-sharing functions of each such third-party website.

    We are not responsible for any breach of security or for any actions of any Third Parties that receive your Personal Information and we are not/shall be not responsible for their privacy policies or practices as it is beyond our control.

    ALTERATIONS TO SERVICE OR AMENDMENTS TO THE CONDITIONS OF USE

    We reserve the right to make changes to any Giftract Services, policies, terms and conditions including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use the Giftract Services. If any of these Conditions of Use is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

    WAIVER

    If you breach these Conditions of Use and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Use.
